Respondifi Terms of Use

1. Eligibility & Account Responsibility

You must be at least 13 years old to use Respondifi.

You are responsible for:

• Maintaining the confidentiality of your credentials
• All activity conducted through your account
• Compliance with applicable laws and regulations
• Securing any devices used to access the Service

Account Security

You agree to keep your login details confidential and notify us promptly of any suspected unauthorized use. You are responsible for actions taken by anyone who accesses your account.

2. Subscription & Billing

• Subscriptions are billed through Apple In-App Purchases
• Subscriptions automatically renew unless canceled at least 24 hours before renewal
• Introductory access converts to paid subscriptions unless canceled
• Refunds are administered exclusively by Apple
• Cancellation stops future billing but does not guarantee refunds

You are responsible for managing subscriptions through your Apple account.

3. License Grant & Restrictions

Respondifi grants you a limited, revocable, non-exclusive, non-transferable license to use the App for personal or internal business purposes.

You may not:

• Reverse engineer, copy, or resell the App
• Circumvent security, licensing, or usage limits
• Interfere with system integrity
• Access the Service in an unauthorized manner
• Use the App for unlawful, abusive, or deceptive purposes

Acceptable Use

You agree to use Respondifi only with content and accounts you are authorized to access. You may not use the Service for harassment, spam, fraud, or illegal activity.

4. User Content & Data Rights

Ownership

You retain ownership of all content you submit, record, upload, or process through Respondifi ("User Content").

License to Process

You grant Respondifi a limited license to store, process, analyze, and transmit User Content solely to provide and improve the Service.

We do not claim ownership of your content.

5. Speech Recognition & Audio Processing Limitations

Respondifi uses automated speech recognition and audio processing technologies, including third-party services.

You acknowledge and agree that:

5.1 No Guaranteed Accuracy

Speech-to-text transcription is inherently imperfect. Accuracy may be affected by:

• Background noise
• Distance from microphone
• Echo and reverberation
• Bluetooth or headset quality
• Vehicle or outdoor environments
• Wind and ambient interference
• Speaker accents, dialects, slang, or speech patterns
• Crosstalk or overlapping speakers
• Fast, quiet, or unclear speech

Respondifi does not guarantee complete, accurate, or error-free transcription.

5.2 User Responsibility

You are responsible for reviewing, verifying, and correcting transcripts before relying on them.

Respondifi is not responsible for decisions, actions, or outcomes based on unverified transcripts.

6. Artificial Intelligence & Automated Outputs

Respondifi provides AI-powered summaries, drafts, suggestions, and insights.

You acknowledge that:

• AI outputs are generated automatically
• Outputs may contain errors, omissions, or inaccuracies
• Outputs may not reflect complete context
• AI systems may produce unintended or misleading results

Human Review Required

All AI-generated outputs are provided "as-is" and require human review before use.

You remain solely responsible for:

• Communications you send
• Decisions you make
• Documents you rely upon
• Actions taken based on AI outputs

Respondifi does not provide professional, legal, financial, medical, or compliance advice.

7. Network, Connectivity, and Cloud Processing

Some Respondifi features rely on internet connectivity and remote processing.

You acknowledge that:

• Performance may be affected by network quality
• Latency, packet loss, or outages may occur
• Cloud-based processing may be unavailable at times
• On-device and cloud features may behave differently

Respondifi does not guarantee uninterrupted or real-time service under all network conditions.

8. Privacy & Security

We implement commercially reasonable safeguards to protect your data.

However, no system is completely secure. You acknowledge that:

• Transmission over networks involves inherent risks
• Unauthorized access cannot be fully eliminated
• You are responsible for securing your devices

Our data practices are governed by our Privacy Policy.

9. Disclaimers

To the maximum extent permitted by law, Respondifi is provided "AS IS" and "AS AVAILABLE."

We disclaim all warranties, including implied warranties of:

• Merchantability
• Fitness for a particular purpose
• Accuracy
• Reliability
• Availability
• Non-infringement

We do not guarantee that the Service will be error-free, uninterrupted, or perfectly suited to your needs.

10. Limitation of Liability

To the maximum extent permitted by law:

• Respondifi shall not be liable for indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the greater of:
  $100, or
  The fees paid by you in the prior 12 months

This applies regardless of theory of liability.

11. Service Modifications

We continuously improve Respondifi.

We may:

• Modify features
• Add functionality
• Retire features
• Change technical infrastructure

When changes materially affect users, we will make reasonable efforts to provide advance notice.

12. Termination

We may suspend or terminate your access if:

• You violate these Terms
• You fail to pay required fees
• Required by law
• Your use presents risk to the Service or other users

When reasonable, we will attempt to provide notice.

You may stop using the Service at any time.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the jurisdiction where AgileVRMS is formed, without regard to conflict-of-law principles.

You agree to attempt informal resolution before pursuing legal action.

Unless prohibited by law, disputes shall be resolved in the courts of that jurisdiction.

14. Updates to These Terms

We may update these Terms periodically.

Material changes will be communicated through the App or website. Continued use after changes constitutes acceptance.

Final Acknowledgment

By using Respondifi, you acknowledge that:

• Speech recognition and AI are imperfect
• Human review is required
• You remain responsible for your decisions
• These Terms govern your use of the Service
